Who we are

Damen Capital (legal name Damen Capital Fund, a Delaware company) runs this website, damencapital.com. We are a private lender and land note buyer that works with land investors and business borrowers. Contact us at eric@damencapital.com or 302-526-0200.

What we collect

We collect information you give us and information your browser sends automatically.

Information you give us. When you fill out a quote, contact, payoff, note tape, storage deal, or guide request form, or use our loan application, we collect what you enter: your name, email address, phone number, company name, and details about your property, note, or deal. If you email, call, or text us, we keep that correspondence.
Documents you send. A loan application may include purchase contracts, entity documents, and other files you choose to upload.
Credit authorization. If you complete a credit authorization form, that information is collected through our e-signature provider and used only to evaluate a loan.
Automatic information. Like most websites, we use analytics that record your IP address, browser type, device, pages viewed, and how you arrived at the site. This is collected through cookies and similar technologies.

How we use it

To answer your inquiry and give you a quote, offer, payoff statement, or loan decision.
To underwrite, close, and service a loan or note purchase you enter into with us.
To send you emails about land lending, note buying, and our programs if you asked for them. Every marketing email has an unsubscribe link.
To call or text you about your inquiry. See "Calls and texts" below.
To understand how the site is used so we can improve it.
To comply with law and protect against fraud.

Calls and texts

When you give us your phone number on a form, you agree that we may call or text you about your inquiry. Message and data rates may apply. Reply STOP to any text to opt out, or tell us by email or phone. We do not sell your phone number or share it for anyone else's marketing.

Who we share it with

We do not sell your personal information. We share it only with service providers that help us run the business, and only for that purpose:

Form processing (Web3Forms) and Google Forms for the loan application
Google Analytics for site usage
A chat widget and customer relationship system (LeadConnector / HighLevel)
Email marketing (Mailchimp)
E-signature and credit authorization (RabbitSign) and credit reporting agencies, when you authorize a credit check
Title companies, closing attorneys, loan servicers, appraisers or valuation vendors, and the law firm, as needed to close and service a loan or note purchase
Co-lenders on a specific loan, limited to what they need to evaluate that loan

We may also disclose information if the law requires it, to enforce our agreements, or in connection with a sale or merger of the business.

Cookies and analytics

We use Google Analytics to measure traffic. Google may set cookies and collect your IP address and usage data under its own privacy policy. You can block cookies in your browser or install the Google Analytics opt-out add-on. Pages with embedded YouTube videos or Google Fonts load content from Google, which may also set cookies.

How long we keep it

Inquiries we keep for as long as needed to respond and follow up, usually up to three years. Loan and note purchase records we keep for the life of the loan or note plus the period required by law and our lenders and co-lenders. You can ask us to delete an inquiry at any time; see "Your choices."

Unsubscribe from marketing email using the link in any email.
Reply STOP to opt out of texts.
Email us to see, correct, or delete the personal information we hold about you. We will confirm your identity first and respond within 45 days. Records tied to a funded loan or note purchase may have to be kept for legal reasons.

Residents of states with consumer privacy laws (such as California, Colorado, Connecticut, Virginia, and others) may have additional rights, including the right to know what we collect, delete it, and not be discriminated against for asking. We honor these requests regardless of where you live. We do not sell personal information and do not use it for targeted advertising across other websites.

Security

Forms on this site are sent over an encrypted connection. We limit access to your information to people who need it. No method of transmission or storage is perfectly secure, so we cannot guarantee absolute security.

Children

This site is for business borrowers, land investors, and note holders. It is not directed to anyone under 18 and we do not knowingly collect information from minors.

Links to other sites

We link to third party sites and tools. Their privacy practices are their own. Read their policies before giving them information.

Changes

We may update this policy. The date at the top shows the latest version. Material changes will be posted on this page.
