By using damencapital.com (the "site") you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the site. The site is operated by Damen Capital (legal name Damen Capital Fund, a Delaware company).
Everything on this site is general information about our lending and note buying programs. Nothing here is a loan commitment, an offer to purchase a note, or a promise to fund. Rates, fees, terms, and criteria shown on the site can change without notice and are subject to our review of the property, the borrower or note seller, title, and the documents. A written quote, pre-approval letter, or offer from us is not binding until the loan or note purchase closes and the signed documents govern.
We make loans to businesses and investors for business purposes only. We do not make consumer loans or loans for personal, family, or household use, and we do not lend on a borrower's primary residence. We are not a bank, mortgage broker, or consumer lender. Some states and property types are excluded, as described on the site.
The note value calculator, loan cost calculator, instant quote, and any other tool on the site produce estimates from the numbers you enter. They are not offers and may not reflect the final price or terms. Actual results depend on our own valuation and underwriting.
Information about co-lending or investing with us is provided for informational purposes only to people who ask about it. It is not an offer to sell or a solicitation to buy any security or interest, and no offer is made through this site. Any arrangement is documented separately, and past results do not guarantee future results. Any investment in a loan carries risk, including the risk of loss.

These terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules. Any dispute about the site will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction. Loan and note purchase documents have their own governing law and venue clauses, which control for those transactions.
We may change these terms at any time by posting a new version here. The date at the top shows the latest version. Continued use of the site after a change means you accept it.
